CONDITIONS OF PARTICIPATION IN ORGANIZED TRAINING
BY EMT-SYSTEMS Sp. z o. o.

I. TRAINING ORGANIZER

  1. The training organizer is EMT-Systems Sp. z o. o. with its registered office in Gliwice (44-100) at 35A Bojkowska Street, registered in the District Court in Gliwice, 10th Commercial Division of the National Court Register under the KRS number: 0000351335, NIP: 6342741010, REGON: 241529768, share capital PLN 1.000.000,00.

II. REGISTRATION OF PARTICIPATION

  1. To register for the training, you must:
  • Complete the application form and send the scanned document electronically to the contact details provided on the EMT-Systems Sp. z o. o. website.
  • and/ or

  • complete the online form available on the EMT-Systems website (the form does not require a signature from the person ordering the service and is tantamount to acceptance of the Terms and Conditions of Training Services)
  1. Submitting an application for participation in the training is tantamount to acceptance by the Ordering Party of the conditions of participation in the Training resulting from the order and these General Terms and Conditions

III. ENTRY INTO THE LIST OF PARTICIPANTS

  1. Within 2 working days of submitting the registration form to the Organizer, the Ordering Party will receive via e-mail a confirmation of the Participant’s inclusion on the training list – Confirmation of participation in the training.
  2. The conclusion of a binding contract for the provision of training services takes place when the Organizer confirms participation in the Training.
  3. After submitting the application, but no later than 5 days before the Training date, the Ordering Party will receive detailed information regarding participation in the training.
  4. The number of places in the training sessions is limited. Registrations will be accepted on a first-come, first-served basis.

IV. TRAINING PRICES AND PAYMENT TERMS

  1. Payment terms can be negotiated individually. Unless otherwise agreed, prepayment must be made no later than 14 days before the training begins.
  2. Please make payments by bank transfer to the account of EMT-Systems Sp. z o. o. at ING Bank Śląski SA. Account number: 86 1050 1298 1000 0090 3025 5591. The participant can also pay for the training via the external payment system imoje, operated by ING Bank Śląski SA with its registered office in Katowice.
  3. Payment for the training can be made online via instant transfer, BLIK, card or imoje using payment links generated by the employee, provided that the training organizer does not run an online store and sales are based on an email confirmation with a payment link.
  4. The training may be paid in installments through the mojeing service, subject to the provisions of point V, paragraph 1 and point VI, paragraph 4 of these terms and conditions.
  5. The prices quoted are net prices for one person taking part in the training, to which the statutory VAT at the applicable rate of 23% should be added.
  6. Prices for open training sessions held at EMT-Systems' headquarters include: participation in the classes, a complete set of training materials, implementation of the program using training equipment, lunch, beverages, and sweets. Prices do not include accommodation, travel, or parking. The scope of closed training sessions is determined individually. The course is held at the company's headquarters, so the buyer is not responsible for delivery costs.

V. WITHDRAWAL FROM PARTICIPATION

  1. Cancellation of participation in the training must be notified to EMT-Systems via email no later than 7 business days prior to the training start date, free of charge. If you choose to pay by installments, you can cancel the training free of charge up to 14 days prior to the start date, provided the first installment has not been paid.
  2. In the case of training paid for in one go via traditional transfer or online payment, cancellation notified less than 7 business days before the start date of the training will result in the Applicant being obliged to cover 50% of the net value of the training based on the issued VAT invoice.
  3. In the case of training paid in installments, when the first installment has been paid:
    1. if the cancellation is notified within 7 working days before the start date of the selected training – the Applicant undertakes to cover 100% of the training value based on a VAT invoice and receives a training voucher worth 100% of the training price, valid for 12 months.
    2. If the cancellation is notified less than 7 working days before the start date of the training, the applicant is obliged to cover 100% of the training value on the basis of a VAT invoice and receives a training voucher worth 50% of the training price, valid for 12 months.
  4. At any time, the person registering for the training may designate another participant for whom they assume full responsibility. Any changes to the participant must be communicated to an EMT-Systems Sp. z o. o. employee by phone or email.
  5. If during the course a student disrupts the training, prevents the course from being conducted or poses a threat to himself or herself and other participants, EMT-Systems has the right to refuse the student further participation in the training.

VI. WITHDRAWAL FROM THE CONTRACT

  1. This point applies only to consumers and entrepreneurs with consumer rights.
  2. A consumer is considered to be an individual who enters into a legal transaction with an entrepreneur that is not directly related to their business or professional activity. An entrepreneur with consumer rights is considered to be an individual who enters into a contract directly related to their business activity, when the content of the contract indicates that it is not of a professional nature for them, arising in particular from the subject of their business activity, disclosed under the provisions of the Central Registration and Information on Business.
  3. A participant who books a training course as a consumer or an entrepreneur with consumer rights has the right to withdraw from the concluded contract in writing without giving any reason within 14 (in words: fourteen) days from the date of conclusion of the contract under the Consumer Rights Act.
  4. Pursuant to Article 15, Section 3 of the Consumer Rights Act, if a consumer or entrepreneur with consumer rights books a training course that is to begin before the expiry of the 14-day withdrawal period, the booking is conditional upon the consumer submitting a declaration that he or she requests the service to be performed before the expiry of the withdrawal period and has acknowledged the loss of the right to withdraw from the contract once it has been fully performed by the entrepreneur.

VII. CHANGES TO THE TRAINING DATE

  1. EMT-Systems Sp. z o. o. reserves the right to change the training date or cancel the training.
  2. In the event of cancellation or change of the training date and the Applicant not agreeing to the new training date, the Applicant retains the right to demand a refund of the amount paid, and in the case of training paid in installments, the ordering party will receive a training voucher.
  3. The training voucher is valid for 12 months from the date of issue.

VIII. COMPLAINTS

  1. The Ordering Party has the right to submit complaints regarding training no later than 7 calendar days from the date of completion of the training.
  2. A complaint may be submitted in the form of:
    • in writing – by post, courier or in person at the registered office of EMT-Systems, address: ul. Bojkowska 35A, 44-100 Gliwice
    • electronically, by e-mail to the e-mail address: info@emt-systems.pl
  3. EMT-Systems Sp. z o. o. should consider the complaint within 7 calendar days from the date of receipt and respond to it in writing or by email within that time.

IX. TRAINING COMPLETION CERTIFICATE

  1. Participants receive a bilingual (Polish-English) certificate confirming their participation in the training. For non-standard training courses, translation of the certificate into a foreign language is arranged individually.
  2. The condition for obtaining a certificate of completion of the training is participation in at least 80% of the classes on all days of the training.

X. ADDITIONAL INFORMATION

  1. The Organizer declares that the materials made available to Participants during the Training are protected by copyright. The Client and/or Participant have the right to use them only for permitted personal use. Copying, reproduction, distribution, or any other form of use of these materials beyond the limits permitted by law is prohibited.
  2. Training sessions are held at a location designated by the Organizer, depending on the type of training. Participants are informed of the training location prior to each session.
  3. The organizer reserves the right to have the course of the training inspected by company employees and authorized external entities.
  4. EMT-Systems is the sole owner of the services offered and their sale is not subject to any restrictions.

XI. PERSONAL DATA PROTECTION

  1. The controller of the personal data of the Ordering Party and Participants is EMT-Systems Sp. z o. o. with its registered office at ul. Bojkowska 35A, 44-100 Gliwice. Personal data is processed for the purpose of fulfilling the training contract and for marketing purposes in accordance with applicable law.
  2. The participant has the right to full access to his/her personal data, to transfer them, to rectify them, to delete them or to limit their processing, as well as to lodge a complaint with the President of the Personal Data Protection Office if he/she considers that his/her rights have been violated.
  3. In the case of an employee registration by an employer, data processing is necessary to fulfill legally justified purposes, i.e., carrying out employee training. Therefore, the processing of the Applicant's personal data by the Training Organizer is permissible under the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation). Furthermore, the Applicant, as the Controller of data of training participants, pursuant to Article 28 of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation), hereinafter referred to as the GDPR, entrusts EMT-Systems Sp. z o. o. with its registered office in Gliwice, ul. Bojkowska 35A, hereinafter referred to as the "Contractor", personal data of persons participating in training courses organized by EMT-Systems Sp. z o. o., within the scope of personal data necessary to conduct the training, i.e. name and surname, date, place of birth and other personal data, if the right or obligation to disclose them results from legal provisions.
  4. The applicant also assumes the information obligation arising from current legal provisions to inform training participants whose personal data are being processed and about their right to access their personal data and to request their correction or deletion.
  5. In the case of an individual registration, data processing is necessary for the performance of the training service agreement to which the Applicant will be a party, and is necessary to take steps prior to entering into the agreement at the Applicant's request. Therefore, the processing of the Applicant's personal data by the Training Organizer is permitted under Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation). Applicants have the right to access and correct their personal data, to request that their processing be discontinued, and to request their deletion.
