The legal aspects of the cybersecurity system are governed by dedicated EU Directives and national regulations. One of the most important documents is the NIS2 Directive, which replaces the previous NIS Directive.

October 18, 2024 was the deadline for implementing the provisions of this directive into national law in Poland under the Act on the National Cybersecurity System. The National Cybersecurity System applies to selected entities, including key service operators (KSOs), digital service providers (DSPs) and public entities. Enterprises identified as “Essential Service Operators” have between 3 and 12 months to comply with the requirements of the regulation.

Key entities are energy, transport, banking, financial market infrastructure, healthcare, drinking water, wastewater, digital infrastructure, OCT service management, public administration, space.

Important entities are: postal and courier services, waste management, production, manufacturing and distribution of chemicals, food production/processing and distribution, manufacturing, digital service providers, scientific research.

Enterprises operating in the group "key entities” have received or are receiving administrative decisions under the currently applicable NIS/KSC procedure. They are obliged to fulfil the obligations arising from the UKSC.

Under NIS2, "significant entities" will not receive administrative decisions, which, consequently, does not exempt them from implementing, documenting, and demonstrating compliance. The "Size cap" rule applies: The scope of NIS2 covers all entities that qualify as medium-sized enterprises and operate in sectors covered by the Directive, services, or activities specified in the Directive. Excluded are "SMEs" (micro, small, and medium-sized enterprises)—those employing fewer than 250 people/with an annual turnover of less than EUR 50 million/with an annual balance sheet total not exceeding EUR 43 million.
